Medical negligence is the failure of a healthcare provider to provide an accepted standard of care, resulting in injury or harm to a patient.
A doctor or health centre is responsible for not only his own action but also for the negligence of his/ her employees, if such an act occurs under his direct supervision, by the principle of Respondent Superior.
The most common types of medical negligence cases include misdiagnosis, medication errors, intensive-care errors, surgical errors, and birth-related injuries.
If you believe that you have been a victim of a needless medical negligence suit, it is important to speak to a specialised medical negligence lawyer as soon as possible. They will be able to advise you on the best course of action and help to ensure that you are able to make the best representation in the court and/ or state medical council taking into consideration appropriate facts. The first representation is the most important and can determine the outcome of the suit.
The process for defending a medical negligence claim will vary depending on the circumstances of the case. Generally, it will involve obtaining medical records and speaking to relevant witnesses, gathering evidence, and submitting a formal reply to the respective court or medical council. If the defence is successful, you will be protected against all legal penalties, claims and disciplinary actions.
Generally, the patient has three years from the date of the alleged injury or when the patient or their caregivers became aware of the injury, to make a medical negligence claim. However, this time limit can vary depending on the circumstances.
Under Criminal law of India when it is proved that the negligent act is performed with Mens Rea (guilty mind) he/she shall be punished under the criminal law (CrPC), which may involve financial penalties and/ or jail term.
